The deputy head of the pro-Morsy Wasat Party, Essam Sultan, was released pending the charges of inciting torture during the pro-Morsy Rabaa al-Adaweya sit-in.
Sultan faces charges of inciting the killing of three citizens in addition to inciting violence, torture and setting fire to a government-owned company building.
The defense asked that the defendant be released based on lack of evidence for his remanding and argued that the charges against Sultan are baseless.
The prosecution had decided last session to imprison Sultan for 15 days pending investigation into the case.
The families of the three victims, Ahmed Hassan Qamar al-Dawla, Ahmed Znikha and Amr Magdi Ali, accused Sultan, Muslim Brotherhood Supreme Guide Mohamed Badie, Mohamed al-Beltagy, Essam al-Erian, and pro-Brotherhood preacher Safwat Higazy of incitement to kill them.
