Lack of evidence enables Mubarak to avoid investigation for protester deaths

Ousted President Hosni Mubarak has so far escaped investigation in connection with the killing of demonstrators during the 25 January revolution because none of the suspects in the case have implicated him in their testimonies, according to a judicial source. The lack of testimony against Mubarak means that there is no evidence on which to base an investigation.

The source said the law states that criminal responsibility falls on people in their “person” and not in their “capacity”. The situation was different for former Interior Minister Habib al-Adly, as his assistants testified that he had “personally” given an order to shoot demonstators, although he did not personally carry out the shootings.

The source further explained that Mubarak would have been summoned for investigation had al-Adly testified that he gave him the order.
